This document is dated 1796, Bennington, Vermont is from Judge Nathaniel Brush, commanding Robert Smith be taken into custody until he can hear out the complaint of William Henry...signed at bottom by Nathaniel Brush and again on back by Brush attesting to the sale of goods and being unable to find William Henry. Document is 8x12, toning, paper loss at center, else in overall good to Bennington about 1775; he commanded the militia of that town in the battle of Bennington  Nathaniel Brush's regt., Vermont Militia, at Saratoga in Oct 1777, witnessed Burgoyne's surrender.

General Stark's exact force was three New Hampshire regiments of militia, under the respective commands of Colonels Hubbard, Stickney, and Nichols; a body of militia under Colonel William Williams, from the east side of the mountains; Colonel Herrick's corps of Rangers, formed under the authority of the Vermont Council, of Safety; a body of militia from Bennington and vicinity, under Colonel Nathaniel Brush, of which two companies, commanded by Captains Samuel Robinson and Elijah Dewey, were from Bennington, and the force under Colonel Simmons from Berkshire County, making altogether about eighteen hundred men.

Brush later  served as judge of probate in 1781 and from 1787 to 1794, and as clerk of the courts from 1787 to 1803.
