This is a nice, original Supreme Court Trial Coles Bashford vs William Barstow.This case established the independence of the Wisconsin Supreme Court (which was then in itsinfancy) and also established the important principle that the Court has the final say as to what thelaw is in Wisconsin. In a unanimous opinion, a three-justice panel entered a judgment removing anincumbent governor from office. Chief Justice Edward V. Whiton wrote the opinion with JusticeAbram D. Smith concurring.
The attorney general filed suit seeking to remove William Barstow, the Democraticincumbent from Waukesha, from the office of governor. Although Barstow had been certified bythe board of canvassers as the winner (by a 157-vote margin) of the 1855 election, it was laterdiscovered that his victory was the result of fraudulent returns from nonexistent precincts inWisconsin’s sparsely populated north. The attorney general asserted that Coles Bashford, theRepublican challenger and a former state senator, had in fact won the election and that he, notBarstow, was entitled to hold the office of governor.
Measures 5 1/2" x 8 1/4" and contains 368 pages.
There is significant wear, front cover detached and chipping, back cover nearly detached, tears, chipping and significant paper loss. Interior pages yellowed at edges, some creases/chipping, text sharp and legible. Previously possessed by the Wisconsin Historical Society.
